Chapter 9 - The Final Judgment

Six months later, Judge Margaret Thornton presided over the final dissolution hearing in the Cook County Domestic Relations Division.

The courtroom was quiet, save for the rustle of documents as Victoria Vance presented the negotiated settlement agreement. Daniel sat beside his public attorney, looking ten years older, dressed in an off-the-rack suit that was fraying at the cuffs. Patricia sat in the back row of the gallery, glaring daggers at Emily’s back, her arms tightly crossed over her chest.

""Having reviewed the forensic accounting reports and the respondent’s history of intentional asset concealment,"" Judge Thornton spoke from the bench, her voice ringing with stern authority, ""this court finds that the respondent acted in gross bad faith and breached his statutory fiduciary duty to the marital estate.""

The judge looked directly at Daniel, who kept his gaze firmly fixed on the wooden table.

""Under the Illinois Marriage and Dissolution of Marriage Act, where egregious financial fraud has occurred, the court is entitled to award a disproportionate share of the marital assets to the innocent spouse. Therefore, the court orders as follows:

""First, the concealed brokerage account containing $386,214, along with accrued interest, is awarded in its entirety—one hundred percent—to the petitioner, Emily Hale, as compensatory damages for fraud and dissipated assets.

""Second, the respondent shall reimburse the petitioner for the eighty-four thousand dollars extracted from her personal municipal earnings, to be paid via an immediate garnishment of any future income.

""Third, the petitioner shall bear zero liability for the forty-two thousand dollars in unauthorized charges incurred on the Worth Avenue transactions; that liability remains exclusively with the respondent and third-party defendant Patricia Hale.""

Judge Thornton brought her wooden gavel down with a sharp, definitive crack. ""The marriage between Emily Hale and Daniel Hale is hereby dissolved. Court is adjourned.""

Patricia let out a loud, strangled gasp from the gallery, rising to her feet as if to shout at the judge, but the bailiff immediately stepped into the aisle, pointing a stern finger toward the exit.

Daniel buried his face in his trembling hands, his shoulders shaking with silent, defeated sobs.

Emily didn't look back at either of them. She picked up her leather handbag, shook Victoria Vance’s hand with warm gratitude, and walked down the center aisle of the courtroom with her head held high. When she pushed open the heavy double doors into the bright Chicago sunshine, she took her very first breath of completely unburdened air.
