Chapter 6 - The Emergency Custody

With Nolan and Vanessa in custody, the courtroom fell into an eerie, peaceful hush.

Judge Walsh removed her reading glasses, rubbing the bridge of her nose before turning all her attention to me.

"Mrs. Dawson, please take a seat. Let us resolve the matter of the children."

I sat down at the petitioner's table, my heart pounding against my ribs. "Your Honor... Owen is not my biological child. His biological mother passed away when he was two years old. Nolan was his sole legal guardian."

The fear in my chest was colder than any financial devastation Nolan could have ever threatened. The thought of Owen being placed into the foster care system made it hard to draw a breath.

Judge Walsh leaned over her desk, looking down at Child Advocate Reynolds, who had just stepped back into the courtroom.

"Advocate Reynolds, what is the recommendation of the Department of Social Services?"

"Your Honor," Reynolds answered clearly, stepping forward to the podium. "We have conducted an immediate review of the household dynamic. For the past four years, Claire Dawson has been the primary caregiver, medical contact, and psychological anchor for Owen Dawson."

Reynolds pulled a sheet of paper from her folder. "Owen has explicitly stated to our forensic interviewer that Mrs. Dawson is his real mother. In light of the severe criminal charges against the father, placing the child in foster care would inflict irreparable emotional trauma."

"Mrs. Dawson," Judge Walsh addressed me directly. "Are you prepared to assume immediate physical and legal custody of Owen, despite being in the final weeks of a high-risk pregnancy?"

"With every breath in my body, Your Honor," I answered, tears streaming down my face. "I love that boy as if I carried him myself. I will never let anyone hurt him again."

Judge Walsh nodded firmly, signing an official court document with deliberate, sweeping strokes of her fountain pen.

"It is hereby ordered that emergency sole legal and physical custody of minor child Owen Dawson is granted immediately to Claire Dawson," Judge Walsh declared. "Furthermore, this court issues a permanent restraining order forbidding Nolan Dawson and Vanessa Cole from having any contact with either minor child, directly or through third parties."

The relief that washed over me was so overwhelming that I almost collapsed into my attorney's arms.

"Now," Judge Walsh added, adjusting her papers. "Let us talk about the marital estate."
