Chapter 9 - The Trial of Truth

Courtroom 402 of the Daley Center in downtown Chicago smelled of polished walnut, old paper, and institutional wax. Outside the tall windows, a grey autumn rain streaked across the glass, matching the grim atmosphere inside.

Judge Arthur Vance—no relation to the officer, but bearing the same stern, no-nonsense Midwestern temperament—sat behind the high wooden bench, reviewing a towering stack of filings.

Linda sat at the plaintiff's table, looking significantly less polished than she had on my porch six days ago. Her hair was pulled back into a hasty bun, her blouse was slightly wrinkled, and her hands tapped an erratic rhythm on the wooden table. Beside her sat a young, visibly uncomfortable attorney from a legal aid clinic who looked like he had been handed the case forty minutes before the hearing.

Gabriella sat beside me at the defense table, immaculate in a navy blue suit, her laptop open and two neat binders resting before her. Edward sat in the gallery directly behind us, dressed in a clean grey suit he had borrowed from David Miller, sitting upright with his hands clasped between his knees.

""All right,"" Judge Vance said, taking off his reading glasses and looking down at Linda’s attorney. ""Counselor, I have reviewed your emergency petition for immediate possession, injunctive relief, and half a million dollars in tort damages against Mrs. Hope Mendoza and the Mendoza Family Trust. Do you have anything to add before I rule on the defense’s motion to dismiss with prejudice?""

The young lawyer stood up, clearing his throat nervously. ""Your Honor, my client, Mrs. Linda Mendoza, was unlawfully removed from her primary residence without formal thirty-day process under the Illinois Forcible Entry and Detainer Act. She was subjected to emotional trauma and effectively rendered homeless by her mother-in-law, who utilized law enforcement under false pretenses of elder abuse.""

Judge Vance shifted his gaze toward Gabriella. ""Ms. Santos?""

Gabriella rose smoothly, buttoning her jacket. ""Your Honor, the plaintiff's claims are an insult to the court. We have submitted Exhibit A: the certified deed demonstrating that the property at 1428 North Lakewood has been held continuously by the Mendoza Family Irrevocable Trust since 2014. The plaintiff has never held a lease, paid rent, or established lawful tenancy.""

""She was an invited guest!"" Linda interrupted, jumping to her feet despite her lawyer’s desperate tug at her sleeve. ""She invited us! And then she ambushed me! She had the police waiting like I was a criminal!""

Judge Vance struck his gavel once. The crack echoed through the courtroom like thunder. ""Mrs. Mendoza, you will not speak out of turn in my courtroom. Another outburst, and you will spend the afternoon in holding for contempt. Sit down.""

Linda sank back into her chair, her face burning red.

""Furthermore, Your Honor,"" Gabriella continued without missing a beat, ""we have submitted Exhibit B: audio and video transcripts from the interior security system of the residence, recorded with full legal notice on the evening of October 24th. In these recordings, Mrs. Linda Mendoza explicitly states her intention to force Mrs. Hope Mendoza into an elder care facility, demands that she eat her meals outside on the patio, and boasts of her scheme to fraudulently encumber the trust assets.""

Gabriella turned slightly, gesturing toward Edward.

""We have also submitted Exhibit C: the sworn affidavit of Edward Mendoza, confessing to the fraudulent attempt to register a forged quitclaim deed, which was orchestrated under financial coercion by the plaintiff. Mr. Mendoza has fully cooperated with the Cook County Financial Crimes Division and has already begun formal restitution with his former employer.""

Judge Vance looked over his glasses at Linda. His expression was not just stern; it was filled with deep, simmering disdain.

""Mrs. Mendoza,"" Judge Vance said, addressing Linda directly. ""In my twenty-two years on this bench, I have rarely seen a filing so utterly devoid of legal merit, so predatory in its design, and so morally reprehensible.""

Linda’s lawyer slowly sank into his chair, sliding his papers together and clearly wishing he were anywhere else on earth.

""You attempted to defraud an irrevocable trust,"" Judge Vance stated, his voice ringing with absolute finality. ""You attempted to dispossess a seventy-year-old widow of her lawful home through psychological terror and financial deceit. And when you were caught, you had the unmitigated gall to file a frivolous tort claim in this court to continue your campaign of harassment.""

Judge Vance picked up his pen and signed the order before him with a sharp, heavy stroke.

""The plaintiff's motion is dismissed with prejudice,"" Judge Vance ruled. ""Furthermore, under Illinois Supreme Court Rule 137, I find this entire action to be frivolous and retaliatory. Sanctions are hereby entered against Mrs. Linda Mendoza in the amount of twelve thousand four hundred dollars, payable directly to Santos, Miller & Keller LLP for legal fees incurred by the defense.""

Linda let out a strangled gasp, burying her face in her trembling hands.

May you like

""And finally,"" Judge Vance added, looking at the second file on his desk. ""Regarding the emergency cross-petition for child protection: full temporary physical and legal custody of the minor children Sarah and Dylan Mendoza is awarded to their father, Edward Mendoza, and co-guardian Hope Mendoza. Mrs. Linda Mendoza is granted supervised electronic visitation for one hour per week, contingent upon her completion of a comprehensive psychiatric evaluation and compliance with all outstanding child support orders. We are adjourned.""

The gavel slammed down.
