Chapter 6 - The Web Unravels

Judge Harrison took a deep breath, setting his pen down on the blotter. He turned his gaze toward Vance, who had pushed his legal pads aside and sat with his hands folded, completely abandoning any pretense of an argument.

“Mr. Vance,” Judge Harrison said softly, a tone far more terrifying than when he was shouting. “Do you wish to cross-examine any witnesses? Do you have any further evidence to offer the court regarding your client’s assertion that Eleanor Bennett was mentally incompetent?”

Vance stood up slowly, clearing his throat. “Your Honor... on behalf of my firm, I formally move to withdraw as counsel for Richard and Diane Bennett. We were misled regarding the material facts of this case, and I cannot in good conscience continue this representation.”

“Motion granted,” Judge Harrison replied without hesitation. “You may step away from the counsel table, Mr. Vance.”

Vance quickly packed his leather briefcase, not even looking at Richard and Diane, and practically sprinted down the aisle and out the double doors, abandoning my parents to face the music alone.

Richard looked completely shattered. The arrogant patriarch who had strutted into the courtroom two hours earlier had shrunk into a hollow, trembling wreck. Diane was weeping uncontrollably, clutching her husband’s sleeve.

“Now, Mr. and Mrs. Bennett,” Judge Harrison said, his voice booming with fury. “Let us address the petition before this court. Not only do I find your challenge to this will completely, utterly without merit, but I also find that this filing was made in egregious bad faith, accompanied by sworn statements that appear to be deliberately perjurious.”

Judge Harrison picked up his gavel.

“The petition to invalidate the Last Will and Testament of Eleanor Bennett is hereby DISMISSED WITH PREJUDICE. Caroline Bennett is confirmed as the sole beneficiary and executor of the $4.7 million estate, with immediate full control of all trusts, accounts, and properties.”

A massive weight lifted off my chest. I looked at Rebecca, who smiled broadly and squeezed my hand. But we weren't done yet.

“Furthermore,” Judge Harrison continued, glaring at Richard, “the court cannot ignore the prima facie evidence of extensive financial crimes committed within this jurisdiction. Under the mandatory reporting statutes for elder abuse, I am officially referring the financial records submitted in Exhibit B to the Multnomah County District Attorney’s Office and the Federal Bureau of Investigation for immediate criminal investigation into wire fraud, grand larceny, and bank fraud.”

Diane let out a bloodcurdling shriek. “No! Please! Your Honor, we are respected people! We have a reputation!”

“You should have thought about your reputation before you robbed an eighty-eight-year-old widow!” Judge Harrison barked. “Additionally, under the no-contest clause and the equitable remedies of this court, I am ordering an immediate freeze on all personal and business bank accounts held by Richard and Diane Bennett pending civil restitution proceedings to recover the $1.2 million stolen from Eleanor Bennett’s estate.”

The judge banged the gavel down with finality. “Court is adjourned.”

As Judge Harrison left the bench, Richard stumbled out of his chair, nearly knocking over his leather chair. He turned toward our table, his face twisted in a mixture of terror, humiliation, and pathetic desperation.

“Caroline!” Richard gasped, rushing toward the wooden railing that separated the gallery from the well of the court. “Caroline, sweetheart! You have to stop this! You're a lawyer—you can tell them it was a misunderstanding! You can drop the charges!”
