Chapter 4 - The Attorney’s Playbook

Eleanor Vance’s office was situated on the top floor of a restored historic brick building on Main Street in downtown Richmond. Eleanor was sixty-two years old, had silver hair cut into a sharp bob, and possessed a reputation among Virginia’s wealthy elite as a legal hurricane. When Eleanor Vance filed an appearance in a divorce proceeding, spouses typically settled within thirty days just to avoid being deposed by her.

At ten that morning, Robert and I sat side-by-side in Eleanor’s leather-bound conference room. The cardboard box from Vanessa’s closet and my midnight spreadsheets were laid out across the mahogany table like evidence in a federal indictment.

Eleanor reviewed the documents over her reading glasses, flipping through the Delaware LLC filings, the lease agreements, and the printed text messages with methodical calm. Occasionally, a thin, razor-sharp smile would touch the corner of her lips.

""Mr. Bennett is remarkably arrogant,"" Eleanor remarked, tapping a manicured finger against the Crestline Solutions operating agreement. ""Most spouses who attempt to hide assets have the good sense to consult a shady offshore boutique in the Caymans. Julian simply registered an LLC in Delaware using his own corporate email address as the recovery contact.""

""He thought I would never look,"" I said. ""He assumed that because I trusted him, I was stupid.""

""A fatal mistake in both business and matrimony,"" Eleanor replied. She looked at Robert. ""Mr. Cole, your situation is more complex because your wife was an active co-conspirator. However, because Julian solicited those funds under false pretenses—promising a joint investment vehicle that never actually existed—he has likely crossed the line from civil breach of fiduciary duty into criminal wire fraud and grand larceny.""

Robert leaned forward. ""Can we put him in prison?""

""We can certainly invite the Commonwealth’s Attorney and the IRS Criminal Investigation Division to take a very close look at his books,"" Eleanor said. ""Julian has been taking untaxed corporate distributions from his employer's side-contracts and parking them in Crestline. Look at these deposits: round numbers, $9,500 each, timed precisely every two weeks.""

I recognized the numbers immediately. ""Structuring. He was keeping the deposits just under the $10,000 threshold to avoid federal Currency Transaction Reports.""

""Precisely,"" Eleanor said, looking at me with approval. ""Mrs. Bennett, your forensic background is going to make this exceptionally painful for your husband. In Virginia, marital waste is taken very seriously. When a spouse dissipates marital assets in furtherance of an affair or with the intent to defraud the other party, the court has the equitable authority to award the entirety of the dissipated sum back to the innocent spouse from the remaining estate.""

""What about the house?"" I asked. ""He made it clear he intended to leverage my emotional attachment to force me into taking on the mortgage debt while he walked with the liquid cash.""

Eleanor took off her glasses and leaned across the table. ""Julian has handed us the holy grail of family law: documentary evidence of premeditated bad-faith dissipation and fraudulent concealment. We are not going to quietly ask for a settlement, Claire. We are going to file an emergency ex-parte motion for a freeze on all Crestline and personal accounts, seize his access to the marital estate, and petition for immediate pendente lite relief.""

""And what happens when he realizes we've locked him out?"" Robert asked.

""He will panic,"" Eleanor said calmly. ""And when men like Julian panic, they scramble to protect their most visible asset: their pride. He will run to his office, he will try to liquidate what little liquid capital he has left, and he will commit another blunder. That is when we drop the hammer.""

She pulled two retainer agreements from her folder and slid them across the table to me and Robert.

""Sign here,"" Eleanor said softly. ""And let’s show your husband what an audit really looks like.""
