Chapter 5 - The Legal Hammer

The very next morning, Marcus Vance and I walked into the chambers of the Honorable Judge Sarah Campbell at the Cumberland County Courthouse.
We weren't filing for a simple restraining order.
We were dropping a legal nuclear warhead.
Marcus had compiled a two-hundred-page verified complaint detailing intentional infliction of emotional distress against a minor, felony cyberstalking, and attempted fraudulent conspiracy to interfere with a testamentary trust.
Judge Campbell, a seasoned jurist known for her zero-tolerance stance on elder abuse and child exploitation, sat behind her bench reviewing the exhibits.
She read the transcripts of the text messages.
She listened to the audio recordings of Laura coaching Sole on how to stage an emotional renunciation.
With every page she turned, the judge's mouth tightened until her lips formed a thin, bloodless line.
"Mr. Vance," Judge Campbell said, looking up from the documents with absolute disgust in her eyes. "Is this accurate? These adults were systematically harassing a thirteen-year-old orphan in order to trigger a trust liquidation clause?"
"Every timestamp has been certified by the state telecommunications forensic unit, Your Honor," Marcus replied smoothly. "Furthermore, yesterday afternoon, the respondents attempted to physically intercept and intimidate the minor child on the grounds of Lincoln Middle School."
Judge Campbell didn't hesitate for a single second.
She reached for her pen and signed three separate orders with aggressive, sweeping strokes.
"I am issuing an immediate, temporary restraining order against George Bennett, Evelyn Bennett, and Laura Bennett-Miller," Judge Campbell announced, her voice echoing off the courtroom walls. "They are barred from coming within one thousand feet of Claire Bennett, Sole Bennett, their residence, their school, and their places of work. Any violation will result in immediate arrest with zero bail eligibility."
"Thank you, Your Honor," Marcus said.
"We are not finished, Mr. Vance," Judge Campbell continued, turning a sharp eye to the trust documents. "Under the probate code of this state, any beneficiary who engages in fraudulent, coercive, or malicious actions intended to thwart the lawful intent of a testamentary instrument may be subjected to immediate judicial forfeiture."
My breath caught in my throat.
"I am issuing an order to show cause," the judge declared. "The respondents will appear in this courtroom in three weeks to explain why their residual beneficiary status in the Arthur Bennett Generational Trust should not be permanently extinguished."
When Marcus and I walked out of the courthouse onto the sunny granite steps, I felt like a massive boulder had been lifted off my lungs.
"What does judicial forfeiture mean, Marcus?" I asked, looking at the embossed court seals on the papers in my hand.
May you like
Marcus smiled, a cold, triumphant gleam in his eyes.
"It means, Claire, that your parents and your sister didn't just fail to steal Grandfather's trust," Marcus said quietly. "It means they are about to lose the only financial safety net they had left in this world."
