Chapter 3 - The Legal Trap Springs Shut

By ten o'clock that morning, the holiday peace had evaporated completely. I dialed the direct office line of Arthur Pendelton, the senior partner at Pendelton, Cross & Sterling. Arthur had been Thomas’s closest friend since their days at Northwestern Law School, and he personally managed the Vance Living Trust.

Arthur answered on the second ring, his gruff voice cutting through the telephone line. ""Barbara? What's wrong? You never call on Boxing Day unless the sky is falling.""

""The sky isn't falling, Arthur,"" I said evenly. ""David is trying to tear the roof off.""

Thirty minutes later, Lucas and I were sitting in Arthur’s mahogany-paneled home office in downtown Chicago, the snow swirling against the high-rise windows overlooking Lake Michigan. Arthur reviewed the digital photographs Lucas had captured from David’s study, his bushy white eyebrows drawing together into a fierce, stormy line. When he reached the forged power of attorney document, he let out a low, dangerous whistle.

""This notary, Brenda Wilkins,"" Arthur muttered, tapping his pen on the desk. ""She’s a contract notary who does freelance work for Chloe’s luxury boutique firm. I know her broker. This is a forged jurat, Barbara. If this hits the state attorney’s office, David and his notary are facing class-three felony charges.""

""I don't want to send my son to prison on Christmas week, Arthur,"" I said, my heart aching beneath the cold resolve. ""Not unless he leaves me no choice. But I will not be put into a home, and I will not allow that woman to strip Thomas’s legacy down to the studs while laughing at me in the foyer of my own house.""

Arthur leaned back, steepled his fingers, and gave me a predatory grin that had terrified corporate boardrooms for forty-five years. ""Then we don't play defense, Barbara. We execute.""

""What are our options?""

""The house in Oak Brook belongs entirely to the trust,"" Arthur said, pulling up our master file on his monitor. ""The occupancy agreement signed four years ago contains an ironclad clause: tenancy is at-will, contingent upon the tenant covering routine interior maintenance and conducting themselves without causing legal or financial nuisance to the trust. Demanding fifty thousand dollars under threat of social alienation, committing notary fraud, and preparing a fraudulent conservatorship petition violates every covenant in this contract.""

Arthur opened a desk drawer, pulled out a stack of pristine legal parchment, and slid it toward me.

""Under Illinois law,"" Arthur explained, ""because David and Chloe breached the terms of their guest occupancy agreement through bad faith and extortionate communication, we can issue an immediate, formal Notice to Quit. Furthermore, because I hold full administrative power of attorney as the designated trust executor, I can file a restraining order barring them from dissipating any connected trust accounts or approaching you.""

""How fast can we move?"" I asked.

""The Cook and DuPage county courts have emergency duty judges on call today for trust protection actions,"" Arthur replied, reaching for his telephone. ""I will have an emergency injunction signed by two o'clock. By four o'clock, the sheriff’s department will serve David and Chloe with a formal thirty-day unconditional eviction notice. And just to ensure they don't liquidate the estate's contents, we are freezing the auxiliary accounts, terminating the trust-funded utility subsidies, and placing an armed private security team at the property gates starting tomorrow morning.""

I looked at Lucas. My grandson nodded slowly, his eyes bright with quiet determination.

""Do it, Arthur,"" I said. ""Every single clause. Every single sanction. Let Chloe find out what it truly costs to sit at the table.""
